What Questions Should I Ask A Divorce Attorney?

Questions to Ask A Florida Divorce Attorney

  1. What is the best strategy for my case? Every divorce attorney has a different strategy, and depending on the circumstances of your case, your divorce attorney may have to do something other than the norm. Asking about the strategy provides you with insight as to what you can expect during your divorce – and whether or not your attorney expects the case to go to family court or resolve out of court.
  2. Who will work on my case? While you may initially meet with an attorney, there may be other individuals in the office handling your case (such as a paralegal, secretary, or another partner).
  3. What costs do you expect for this case? Some divorce lawyers like us charge a flat rate, while others require a retainer and hourly fee. You need to get upfront pricing on your particular case so that you know what to expect. If your divorce is amicable, you will pay less than a divorce case that is heard in front of a family court judge.
  4. Can I negotiate with my spouse directly? Yes you may but some divorce attorneys will strictly prohibit you from negotiating or working out any details with your spouse directly; instead, they will request that all discussions be done through them.
  5. How long will my case take? Your divorce attorney can give you an estimate of what you are looking at based upon how complex your case may be.  The time frame can be anywhere from 1 month to years.
  6. What other areas of the law do you practice? You want to ensure you select a divorce attorney that primarily practices in family law.
