The main distinction between divorce and legal separation is that at the conclusion of a divorce proceeding, the marriage is terminated. With a legal separation, the parties remain married. However, Florida does not recognize legal separation and there is no mechanism to file for one. Some courts may still adjudicate issues such as child support when couples are physically separated.
